    Kubeez provides digital services (content generation) that are delivered immediately upon purchase. By purchasing credits or subscriptions, you expressly request that performance of the digital service begins immediately and acknowledge that you lose your right of withdrawal once performance has begun, in accordance with Article 16(m) of EU Directive 2011/83/EU and Article 16 letter m) of Romanian Government Emergency Ordinance 34/2014. Your statutory rights regarding the conformity of digital content and digital services under Romanian Law 74/2022 (transposing EU Directive 2019/770) remain unaffected and are addressed in section 2 below.

    1. No Refund Policy for Digital Services

    All purchases of credits and subscriptions are final and non-refundable. This policy applies because:

    • Kubeez provides digital services (AI-powered content generation) that are not delivered on a physical medium

    • By purchasing credits or subscriptions, you explicitly consent to the immediate performance of the digital service

    • By accepting our Terms & Conditions, you acknowledge that you lose your right of withdrawal for digital content

    • This exemption is in accordance with Article 16(m) of EU Directive 2011/83/EU and Romanian Government Emergency Ordinance 34/2014

    Credits, whether purchased individually or allocated through subscriptions, cannot be refunded once purchased, regardless of whether they have been consumed (used for content generation) or remain unused.

    2. Service Failures & Technical Issues

    If Kubeez experiences technical failures, outages, or billing errors that prevent you from using purchased credits, we will provide service credits, extensions, or technical remedies to restore your access. Contact support with details so we can investigate and resolve the issue promptly.

    Where the digital service is non-conforming within the meaning of Romanian Law 74/2022 (transposing EU Directive 2019/770), you are entitled to have it brought into conformity within a reasonable time and free of charge. Where bringing the service into conformity is impossible, disproportionate, or unsuccessful, you are entitled to a proportionate price reduction or to terminate the contract and receive a refund of any amount paid for the non-conforming digital service, in accordance with that law. These statutory remedies for non-conformity remain available in addition to, and override, the no-refund rule above where the law so requires.
